It appears that Jim Carrey's legal woes are far from over after an explosive new motion was filed on Friday in a Los Angeles court room.
Carrey is claiming that his late girlfriend Cathriona White forged STD test results prior to her attempt to extort the actor.
Those same files are being used in the wrongful death case filed against Carrey by White's mother, Brigid Sweetman and estranged husband, Mark Burton.
Death Ruled a Suicide
After splitting from Jenny McCarthy, the comedic actor met and fell for a makeup artist from Ireland. They dated on and off for years and everyone thought it was a fairy-tale romance until White was found dead in her Los Angeles home.
Cathriona White took her own life on September 28, 2015, just two weeks after her 30th birthday.
Her death was ruled a suicide by an overdose of sleeping pills, heart medication and pain relievers.
At the scene of her death, police came across two notes, one of which was addressed specifically to Carrey.
Police interviewed Carrey in the months following White's death, ultimately deciding he was not a suspect. The Mask star remained close with her family and was even a pallbearer at her funeral in Ireland.
Lawsuits Against Carrey
After her death, Carrey was shocked to learn that White was married to another man at the time of her death, and he had filed a lawsuit claiming the actor was responsible for his wife's suicide.
During the time that Carrey and White had split, she had married an American by the name of Mark Burton. Their union was described as a marriage of convenience in order to keep her in the country.
Burton's lawsuit claims that one of the medications that was responsible for her death was given to her by Carrey, in spite of him knowing she suffered from depression and had previously attempted suicide.
White's mother has also launched a lawsuit because she believes her daughter was suicidal because of an STD she caught from Carrey.
"Jim Carrey should be ashamed of what he did to my daughter," she writes in her lawsuit. "As a family, we want the world to know the truth about who Jim Carrey really is."
Carrey is not taking these accusations lightly though.
"I will not tolerate this heartless attempt to exploit me or the woman I loved," Carrey said in a statement.
New documents obtained claim Carrey gave White three types of sexually transmitted diseases in early 2013. Their relationship then came to an end and he allegedly asked her to stay quiet about the illnesses. The couple later reconciled.
In an emotional handwritten letter from White after her diagnosis, she tells Carrey, "I am 27-years-old and all that was left of me was a shell and a damaged one at that. Picking myself back up emotionally and mentally is one thing... Add in disease. How does someone move on and meet someone new?... I will always be damaged goods and have a stigma attached. So I have to accept something I was always afraid of. Being alone. Being abandoned and alone."
STD Test Results
The Liar Liar star said that White altered her friend's Planned Parenthood files in order to trick Carrey into believing that she did not have an STD before meeting him.
Using a negative 2013 test result from a friend, White allegedly back-dated the test to 2011 before presenting it to Carrey.
Carrey claims that in 2013, White and her attorney at the time, Filippo Marchino, conspired to extort him "through smears and threats of public degradation via false allegations" that she had received STDs from the actor.
When Carrey did not respond to the alleged threats, that's when White got the falsified documents, he claims.
"White's intent in obtaining these records was clear "” she cooked the records, creating forgeries with altered information, phony tests, and fictitious dates," according to the documents.
In July 2013, Carrey's motion states, "White and her attorney Marchino used the counterfeit records to extort money from Mr. Carrey."
With that behind them, Carrey and White reunited in 2015. Carrey claims that they, however had no plans to marry in spite of White's desire to stay in the country.
They had initally planned to get married until they were drawing up a prenuputal agreement and it became clear to Carrey that the marriage "was more about convenience and finding a way to stay in the United States without fear of deportation than about her love for him."
Fall Out After Her Death
A year after White's suicide, new documents claim, "White's green-card husband and her distant, estranged and emotionally abusive mother decided to get a second bite at the apple and continued the torment of Carrey by filing a lawsuit claiming that he caused White's death."
According to the filing, "The entirety of this case rests on the premise that White contracted sexually transmitted diseases from Carrey and became so devastated that she committed suicide years later."
The filing also states that text messages between White and a friend, prove that White altered the results.
"On April 2, 2013, [White's friend] had a routine appointment at Planned Parenthood to re-fill her birth control contraceptive. During her appointment, she gave a urine and blood sample for a routine HIV test and STD screening and was tested for Syphilis, Chlamydia, and Gonorrhea. The results were all negative," the documents claim.
That's when a text message exchange happened between her and her friend that could indicate that the documents were falsified.
"I don't think there's anything in the papers from Planned Parenthood that'll help you babe." White allegedly replied, "Still bring it I need to see the layout I have to give something."
"Though [her friend] never knew what White intended to do with her medical records or what she ultimately did with them, we now know that White, using a legitimate and official copy of her friend's Planned Parenthood records, forged test results to "˜prove' the lie that she had tested negative for sexually transmitted diseases just prior to her relationship with Carrey and to support her attempt to extort millions of dollars from her famous ex-boyfriend," the filing states.
Carrey's allegations also said that White had dated her report to 2011, prior to meeting Carrey.
Burton and Sweetman do not believe Carrey's claims about the alleged falsified documents.
"In a desperate attempt to save himself, Carrey has now resorted to outright falsehoods. Let's see if his story holds up once he is under oath. It won't," according to Burton and Sweetman's lawyer, Michael Avenatti.
Burton and Sweetman also claim that Carrey gave White "three STDs without warning her."
If the court finds out that the STD results were faked, and Burton knew about it when he filed his document, Carrey has asked that the claims against him to be dropped.
"[Burton's] claims are based on an utter sham, and his false responses to discovery as well as production of forged records constitutes an abuse of the discovery process warranting terminating sanctions," according to the filing.
The 55-year-old actor is set to have his day in court on Friday, October 27, 2017.
"We are very much looking forward to Mr. Carrey finally being placed under oath next week and forced to answer the questions he has been dodging for years," Avenatti said in a statement to Us Weekly on Friday, October 20. "This is a search for the truth and we will find it. And when we do, it will not end well for Mr. Carrey."
